General Terms and Conditions

1. Course Registration

A binding registration via the booking system or by e-mail is required for participation in live lessons, which is binding even without separate written confirmation from Drehmoment. As places are limited, no place can be guaranteed without a binding registration. The course schedule is subject to change at any time. However, in the event of major changes at short notice, the customer will be informed in good time beforehand. All regular courses take place with a minimum of four participants. In the event of an insufficient number of registrations, courses can also be canceled at short notice, but customers will be informed of this via the booking system at least four hours before the start of the course. In this case, the booked credits do not expire and will be credited again. In the case of special events such as long-format monthly programs, workshops or extracurricular course offerings, the conditions and cancellation deadlines published in the corresponding course text apply.
These can always be found in the respective course texts in the course schedule.
By registering for a course, participants confirm that they have read and accepted the GTC.  

2. Terms of Payment

The course fee must be paid in full before the start of the course in order to secure a place on the course. Payments are made automatically via the booking system using the digital payment service providers integrated into the booking system (Paypal, Klarna, and others). Reservations without prior payment do not entitle the holder to participate in a lesson. The prices published at the time of the binding booking apply. All fees include the statutory value added tax.  

3. Validity of the Purchased Packages and Cancellation Deadlines

A general validity period of 2 months applies to all course lesson bookings that can be purchased in the Drehmoment Online Shop, within which the Class Passes can be used in the course schedule. They then expire automatically. Cancellation deadlines for the respective offers are always noted in the course schedule; as a rule, they are 24 hours. Separate cancellation deadlines, such as for in-person workshops, can also always be found in the course schedule for the respective event. The cancellation deadline is also displayed by the booking system for each individual entry to an event in the course schedule. The validity of the remaining credit can be viewed at any time in the customer account within the booking system. Extensions of the validity period are only possible in cases of hardship. Course packages that have already been started cannot be refunded, not even partially. Any offer prices can only be claimed once per customer and per offer. In the case of the subscription offer, the validity and availability of the digitally provided content is bound to the duration of the active subscription.
After termination of the subscription, the content is no longer available to the customer with immediate effect.  

4. Participation and personal Responsibility

Participation in all Drehmoment events is possible from the age of 16. Our offer is aimed exclusively at adult individuals. We work in a group of adults and appeal to the personal responsibility and maturity of all individuals in their dealings with each other, with the course management and in their use of the teaching material. Participants should operate within and respect their personal boundaries, as well as the personal boundaries of other participants and the course leader. It is the responsibility of the participants to communicate any boundaries to the course leader. Booked courses and lessons are always personal and only transferable to third parties if explicitly mentioned. There are no claims for compensation. Passing on the log-in data for the purchased digital content from Drehmoment to third parties is strictly prohibited and may result in the termination of membership.
All virtual live courses via Zoom are recorded and made available as recordings on-demand in the media library.
The participants can be represented in the recordings with their voices; only the course instructor can be seen in the video recording.
The participant hereby agrees to this.  

5. Intellectual Property

The material taught in the courses and all content on this website is the intellectual property of Alisa Saric/Drehmoment Pole.Aerial.Dance.
If this content is passed on for your own purposes, for example on a website or in the context of courses or lessons, it is appropriate for legal and ethical reasons to name Alisa Saric/Drehmoment as the source.
The digitally provided content remains the intellectual property of Alisa Saric/Drehmoment Pole.Aerial.Dance.
With the respective course packages, the customer only acquires the right to stream the content for an agreed period of time.
In the case of fixed course programs, this is a time frame of 2 years, in the case of subscriptions to the Drehmoment media library for the duration of the active subscription.  

6. Course Withdrawal

Since all online offers are recorded and screen recordings of all dates are available and accessible to participants, there are no claims for compensation in the event of non-participation during the live date. The general cancellation deadline for all regular 75-minute courses is 24 hours before the start of the course. Before this period, it is possible to rebook free of charge without giving reasons and to use the Class Pass for another date within the validity period.
In the event of a rebooking via the Torque booking system, the credit used will be automatically credited again.
The rebooking must be made directly and independently in the booking system. All other course formats have their own special cancellation rules, which are explicitly stated in the event texts in the booking system. However, there is no entitlement to compensation in the event of non-observance of the cancellation deadlines and the GTC. Short-term changes to the course management do not entitle the participant to a refund or replacement. In cases of illness, a substitute lesson can be selected in consultation with Drehmoment if a doctor’s certificate is submitted in good time. There is no entitlement to a replacement for special events and workshops. In the event of only partial participation in courses within course packages, there is also no entitlement to a refund or replacement. Likewise, there is no entitlement to compensation if absences due to illness are reported with a long delay. Course fees already paid will not be refunded.  

7. Revocation Instruction

If the service has not already been used and the course credit is suspended, you have the right to cancel the service contracts purchased from Drehmoment within 14 days without giving reasons. The withdrawal period is 14 days from the date of purchase in the webshop. In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration by e-mail to team@drehmomentpole.de. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
In return, any credit balance for corresponding services at Torque will be canceled.
Any services already used are excluded from this and must be paid for by you, see paragraph 6.  

8. Disclaimer

Pole dance, dance and aerial fitness are sports that can lead to increased muscle soreness, bruising and skin abrasions due to the acrobatic elements. Participants acknowledge that this may occur and undertake to inform the course management of any injuries, possible pregnancy and similar obstacles to participation at any time before the start of the course. Drehmoment is not liable for injuries caused negligently by customers. Customers participate at all times at their own risk and responsibility. Working with somatic methods and breathing techniques can lead to complex physiological processes that cause temporary changes in emotional states. The methods used do not replace medical or psychotherapeutic counseling or therapy at any time. The course management has no influence over the inner processes that go beyond the course framework, and decisions regarding the choice of a licensed therapy. Participants acknowledge that participation in the formats offered here may lead to personal changes and that anything beyond the scope of the course is a matter of personal responsibility. No liability is accepted for theft, loss of personal belongings or other losses at Drehmoment’s physical events. Drehmoment is not liable for the accuracy and completeness of the content offered on the website or in social media.  

9. Data Protection

In order to organize the content offered, necessary personal data of customers is stored digitally. Customers consent to the collection and use of this data. Consent can be revoked at any time, which leads to the deletion of the data after the business transaction has been completed. All detailed information can be found in our privacy policy. Drehmoment is entitled to delete customers from the digital customer file in the event of more than twelve months of inactivity (non-utilization of the regular course offer). Any remaining credit balance will be indicated in writing and a request made to redeem it. Participants have the right to information about the data stored by us. Customers have the right to rectification, erasure and restriction of processing under the conditions set out in Art. 16 to 18 GDPR. You have the right to lodge a complaint with the supervisory authority.  

10. Legal Consequences of Invalidity

Should one of the clauses of the General Terms and Conditions be wholly or partially invalid, this shall not affect the validity of the remaining clauses.
