General Terms and Conditions

1. Course registration

To participate in course sessions, a binding registration via the booking system or email is required, which becomes binding upon Drehmoment even without separate written confirmation. As participation slots are limited, a place cannot be guaranteed without a binding registration. Changes to the course schedule are subject to change at any time.

However, in the event of significant last-minute changes, customers will be informed in advance. All courses in the regular course offerings take place with a minimum of four participants. In the event of an insufficient number of registrations, courses may be canceled at short notice, but customers will be informed via the booking system at least four hours before the start of the course. In this case, booked credits do not expire and will be credited back. For special events such as long-format monthly courses, workshops, or extracurricular course offerings, the conditions and cancellation deadlines published in the corresponding course text apply. These are always found in the respective event
descriptions in the course schedule. By registering for the course, participants confirm that they have read and accepted the terms and conditions.

2. Terms of payment

The course fee must be paid in full before the start of the course in order to secure a place. Payments can be made automatically via the booking system using Klarna bank transfer or PayPal. Reservations without prior payment do not entitle participation in a course session. Prices published at the time of booking are applicable. All fees include the legally required value-added tax.

3. Validity of the purchased packages and cancellation deadlines

All course bookings available for purchase in the webshop have a general validity period of 2 months, within which the credits can be used in the course schedule. After this period, they expire automatically. The cancellation deadlines for the respective offers are always noted in the course schedule, usually 24 hours in advance.

Separate cancellation deadlines, such as for in-person workshops, are also visible in the event descriptions in the course schedule. The validity of the remaining credits can be viewed at any time in the customer account within the booking system. Extensions of the validity period are only possible in exceptional cases. Already commenced course packages are non-refundable, even partially. Any promotional prices can only be claimed once per customer per offer.

4. Participation and Intellectual Property

Participation in all Drehmoment events is possible from the age of 16. Our offerings are exclusively for adult individuals. We work within a community of adults and appeal to the personal responsibility and maturity of all individuals in their interactions with each other, with the course instructors, and in their use of course materials. Participants should operate within their personal limits and respect those of others and the course instructors.

It is the responsibility of participants to communicate boundaries to the course instructors if necessary. Booked courses
and sessions are generally non-transferable, and there are no substitution rights unless explicitly stated otherwise. Sharing login credentials for purchased digital content from Drehmoment is strictly prohibited and may result in termination of membership. The material taught in the courses and all content on this website are the intellectual property of Alisa Saric/Drehmoment Pole.Aerial.Dance. In the event of sharing this content for personal use, such as on a website or in courses or instruction, it is advisable, both legally and ethically, to credit Alisa Saric/Drehmoment as the source.

5. Course Cancellation

The general cancellation deadline for all regular 75-minute course sessions is 24 hours before the start of the course. Before this period, cancellation without providing reasons is possible free of charge, and credits can be used for another session within the validity period. In the event of cancellation via the Virtuagym booking system, the used credit is automatically credited back. Cancellations must be made independently in the booking system.

Last-minute changes to the course instructor do not entitle the participant to a refund or replacement. Since all online offerings are recorded and screen recordings of all sessions are available and accessible to participants, there are no substitution rights in the event of non-participation during the live session.

All other course formats have separate cancellation rules, which are explicitly stated in the event descriptions in the booking system. Failure to comply with cancellation deadlines and terms and conditions does not entitle to a replacement. In cases of illness, a replacement session may be selected in consultation with Drehmoment upon timely submission of a medical certificate.

There is no entitlement to a replacement for special events and workshops. There is also no entitlement to a refund or replacement for partial participation in courses within course packages. Likewise, there is no entitlement to compensation or a replacement if illness-related absences are reported with significant delay. Course fees already paid will not be refunded.

6. Right of Withdrawal

If the service has not yet been used and the course credit is unused, you have the right to withdraw from the service contracts purchased from Drehmoment within 14 days without giving any reason. The withdrawal period is 14 days from the purchase in the webshop.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement sent by email to team@drehmomentpole.de. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

7. Consequences of Withdrawal

If you withdraw from this contract, we will reimburse you for all payments received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract.

We will use the same means of payment for the reimbursement as you used for the original transaction unless expressly agreed otherwise; in any case, you will not incur any fees for such reimbursement. Conversely, any credit for
corresponding services at Drehmoment will be canceled. Services already used are excluded from this and must be paid for by you, see Paragraph 5.

8. Disclaimer

Pole dance, dance, and aerial fitness are sports that can lead to increased muscle soreness, bruises, and abrasions due to acrobatic elements. Participants acknowledge that this may occur and commit to informing the course instructor at any time before the start of the course about injuries, possible pregnancy, and similar participation impediments.

Drehmoment is not liable for injuries caused by negligent behavior of customers. Customers participate at their own risk and responsibility at all times. Working with somatic methods and breathing techniques can lead to complex physiological processes that cause temporary altered emotional states/ states of consciousness. The methods applied never replace medical or psychotherapeutic advice or therapy.

The course instructor has no influence over internal processes beyond the scope of the course and decisions regarding the choice of licensed therapy. Participants acknowledge that participating in the formats offered here may lead to personal changes and that anything beyond the course framework is a matter of personal responsibility. Drehmoment does not accept liability for theft, loss of personal belongings, or other losses during physical events. Drehmoment is not liable for the accuracy and completeness of the content offered on the website or on social media.

9. Data protection

Necessary personal data of customers is digitally stored for the organization of the offered content. Customers consent to the collection and use of this data. The consent can be revoked at any time, leading to the deletion of the data after complete business processing. All detailed information can be found in our privacy policy.

In the event of more than twelve months of continuous inactivity (non-attendance of regular course offerings), Drehmoment is entitled to delete customers from the digital customer database. Any remaining valid credits will be notified in writing. Participants have the right to information about the data stored by us. Customers have the right to rectification, erasure and restriction of processing under the conditions set out in Art. 16 to 18 GDPR. You have the right to lodge a complaint with the supervisory authority

10. Legal consequences of ineffectiveness

Should one of the clauses of the General Terms and Conditions be wholly or partially invalid, this shall not affect the validity of the remaining clauses. Insofar as the provisions have become invalid, the content of the contract shall be governed by the statutory provisions.
